Jim Walsh The Arizona Republic Sept. 23, 2003 12:00 AM MESA - A terrorism-backlash murder defendant facing the death penalty "made up" the voice that told him to kill a Sikh gas station owner, a prosecution psychiatrist testified Monday. "This is a symptom that was made up to cover for the true motivation of the crime," Dr. John Scialli said in Maricopa County Superior Court. Scialli said that Frank Roque, 44, is faking mental illness and that it's very strange for a mentally ill person to have hallucinations, such as hearing voices, without also having delusions. Roque shot Balbir Singh Sodhi, 49, to death on Sept. 15, 2001. Roque's contention that he heard the voice of God before he shot Singh Sodhi but not before two drive-by shootings he committed in rapid succession is suspect, Scialli testified. "Symptoms don't turn off at the end of an offense," he said. Roque is pursuing a guilty-but-insane defense. Three out of four experts have testified that he suffers from a mental illness, and two believe he was incapable of understanding right from wrong, Arizona's definition of legal insanity.
